We can protect you or your business by lodging a document known as a “caveat” in the Sheriff Court(s) of your choice and the Court of Session (highest civil court in Scotland). This is a purely administrative exercise. It is a very inexpensive procedure with huge benefits. It can protect you, for example, from parties who may commence court proceedings without your knowledge and obtain damaging “interim orders” such as an interdict against you. If a caveat is lodged the court will not grant an interim order until you are given a reasonable opportunity to instruct your solicitor and resist the interim order application.
