Placing Request Appeal (P3) to Edinburgh Sheriff Court  – The Education (Lower Primary Class Sizes) (Scotland) Regulations 1999 and The Education (Scotland) Act 1980

“Having failed our first appeal, we were distraught.  We lived 22 seconds by foot from our catchment school and already had one child at that school, the youngest (with a serious medical condition) was several miles down the road. After consideration we decided to go to the next level of appeal and therefore needed to seek legal representation.

From the first telephone call we could tell that Martin had an interest in our case and we chatted at length.  He was personal yet professional.  We then arranged to meet as a family.  Whilst we knew Martin could not guarantee a successful outcome, we needed to know that we had good grounds and after our meeting we were confident that we were doing all that we could to try and get our son into our catchment school where his brother is.  Regardless of the outcome, we needed to know that we had exhausted all opportunities and that Martin believed in this case, which we were confident he did.

We were kept up to date will all progress, with phone calls and emails being responded to promptly.  We never felt ‘out of the picture’ and we felt that Martin was working extremely hard for us.  We were never given false hope or promises, even right up until the last minute.  This was extremely important as emotions are high during an appeal like this.

Within weeks we had the best possible outcome and our son moved immediately to his catchment school.  He is now super happy and integrating with his local community, making friends and thriving.  His health has also improved dramatically which was evidently suffering due to this previous circumstances. Our only regret is not contacting Martin sooner.
